Chapter 2.84 TELECOMMUNICATIONS FUND AND TELECOMMUNICATIONS REVIEW COMMITTEE
Section 2.84.040 Determination of city and county pro-rata share of franchise fee and contribution to telecommunications commission budget.
A. The city and the county shall bear
the expense for the Bartholomew-Columbus
telecommunications commission budget on a pro-rata basis which shall be determined as a
percentage of the overall franchise fee paid by the franchisee (cable operator) under the terms of
the franchise agreement, computed as follows:
1. The amount of fees generated from
cable subscribers located within the city limits of the
city, divided by the total franchise fee, shall represent the city's pro-rata share.
2. The amount of the fees generated
from cable subscribers located outside the city limits of
the city, divided by the total franchise fee, shall represent the county's pro-rata share. (For
purposes of this chapter, fees generated from subscribers located in other incorporated or
unincorporated towns within Bartholomew County, but covered by the franchise agreement, shall
be included within the county fees.)
B. The pro-rata share of expenses
to be borne by the city and the county each year shall be
based upon the fees paid by city and county cable subscribers in the previous calendar year. (Ord.
