Chapter 5.04 BUSINESS LICENSES GENERALLY
Section 5.04.050 Application--Investigation and issuance.
5.04.050 ApplicationInvestigation and issuance.
A. The proposed applicant shall secure
from the office of the clerk-treasurer, an application
for a license under this chapter. The applicant shall then file the completed application with the
officer of the clerk-treasurer. A nonrefundable ten dollar filing fee shall be required upon receipt
of
the completed application. Upon receipt of the application, the office of the clerk-treasurer shall
forward the application to the Columbus/Bartholomew county planning department for review and
recommendation. After such review and recommendation. After such review and recommendation,
the application shall be forwarded by the Columbus/Bartholomew County planning department to
the chief of the Columbus police department. After conducting an investigation and review of the
application, the chief of police shall bring the application to the board of public works and safety.
B. The board of public works and safety
shall review the application and the recommendation
of the above noted departments thereon and if the application is found to be satisfactory, shall
direct the clerk-treasurer to issue a license for each person to be licensed upon payment of the fees
required and the posting by the applicant of a surety bond payable to the city of Columbus,
Indiana, in the penal sum of one thousand dollars for each person to be hired or employed by the
applicant for the benefit and protection of the citizens or residents thereof who shall do any
business with the applicant so bonded, and conditioned upon the faithful discharge of every
obligation, statement and representative entered into and made by applicant to his customers under
such license or permit. If, upon review of the application and the recommendation of the above
noted departments thereon, the board of public works and safety determines that the applicant is
found to be unsatisfactory, the application shall be denied and the applicant shall be so notified.
C. The applicant shall have fifteen days
after notice of the denial of his application to submit
any additional information regarding his application which may prove his application to be
satisfactory. If an applicant submits additional information within fifteen days after his denial, the
board of public works and safety shall review the application again. If as a result of the second
review, the board of public works and safety determines that the application is satisfactory, they
shall direct the clerk-treasurer to issue a license to the applicant for each person to be licensed
upon
payment of the fees required. If as a result of the review, the board of public works and safety
determines that the application remains unsatisfactory, the application shall be denied and the
applicant shall be so notified.
D. The applicant then shall have fifteen
days within which to file an appeal to the common
council. The common council shall review the application as set forth in subsection B of this
section. If the application is denied, the applicant may then file an appeal of said denial in the
circuit or superior courts of Bartholomew County within fifteen days of notice of the decision.
E. The clerk-treasurer shall maintain
a complete record of all licenses issued. (Prior code § 20-5)
