8.32.040 Removal after notice—Recovery of cost from owner.
    If the real estate owner shall fail to cut and remove the weeds or rank vegetation within the time prescribed, after receiving the notice, then the board of public works and safety shall proceed to cause such weeds or unkept lawn grasses or other rank vegetation to be cut and removed from said real estate. The clerk-treasurer shall make a certified statement of the actual cost incurred by the city in the removal of the weeds, unkept lawn grasses or other rank vegetation. The statement shall be delivered to the owner or one of the owners of the real estate by a law enforcement officer of the city, or by registered mail, and the owner or one of the owners of said real estate shall pay the amount due to the clerk-treasurer. If the owner or one of the owners fails to pay the amount within ten days after receiving the statement, a certified copy of the statement of costs shall be filed in the office of the auditor of Bartholomew County. The auditor of Bartholomew County shall place the amount claimed on the tax duplicate against the property affected by the work and the amount shall be collected as taxes are collected and shall be disbursed to the clerk-treasurer who shall deposit the funds in the account from which the funds were expended.
