A.    No person shall bathe or swim in any canal, race, stream, pit, pond or other body of water or watercourse within the city, or within an area the city is given jurisdiction over in such instances and which is unguarded by a lifeguard.

    B.    This section shall not apply to pools of the city park department or of clubs or other private beaches or pools which are guarded by lifeguards and also not private swimming pools, lakes or ponds maintained on the grounds of a private residence or which are a part of a private subdivision.
